Waiver of Liability

Program and Offering Description:

BRAINBODY, LLC trainings, workshops, group and/or individual trainings or sessions involve various physical and cognitive training ac vi es, including but not limited to strength and conditioning, speed and agility work, hands-on trainer approaches, functional movement techniques and assessments, neurotraining, nervous system regulation modalities, vestibular and or vision training, as well as other mind body wellness aligned modalities, practices and approaches.

Acknowledgment of Participation Risks:

(Participation in any BRAINBODY, LLC training, program or session is voluntary, and done so under the assumption of risk to present or previous health conditions or concerns.) I, the undersigned, acknowledge and understand that participation in any program offered by or through BRAINBODY, LLC involves inherent risks, including but not limited to:

• Physical injury (e.g., sprains, fractures, muscle strains)

• Overexertion or fatigue Dizziness or imbalance from vestibular or vision training Emotional or psychological stress

• Unforeseen accidents or injuries Unforeseen damage to personal property

  Assumption of Risk:

  I voluntarily assume all risks associated with my/my child's participation in a BRAINBODY, LLC training, program or session, including any harm that may result from the activities described above, whether caused by the negligence of the training staff or otherwise. Release of Liability: In consideration of being allowed to participate in a BRAINBODY, LLC offering, I, on behalf of myself, my child, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue BRAINBODY, LLC, its officers, agents, employees, volunteers, and other participants (collectively, the "Released Parties") from any and all claims, demands, actions, or causes of ac on arising out of or connected with my/my child's participation in any offering, including any claims arising out of the negligence of the Released Parties.

  Indemnification:

  I agree to indemnify and hold harmless the Released Parties from any and all claims, demands, actions, or causes of action, including attorney(s) fees and costs, arising out of or related to my/my child's participation in the Program.

  Medical Treatment:

  I give permission for the training staff to seek emergency medical treatment for my child if necessary and agree to be responsible for any costs incurred as a result of such treatment.

  Photography/Media Release:

  I grant permission for my/my child's photograph, video, or likeness to be used for promotional purposes by BRAINBODY, LLC without compensation.

  Acknowledgment of Understanding:

  I have read this Liability Waiver, fully understand its terms, and understand that I am giving up substantial rights, including the right to sue. Through the purchase or use of any BRAINBODY content, program, merchandise, services, tools, or locations- I acknowledge that I am signing and or agreeing to this agreement freely and voluntarily and intend for this acknowledgement to be a complete and unconditional release of all liability to the greatest extent allowed by law.
